Introduction

FunXtion believes that your personal data should be treated with the utmost care. In this Statement, you can read what kind of personal data we collect and how we protect and use your personal data.

Definitions

Interactive Platform: a cloud-based multi-device open platform provided by FunXtion, which is designed for functional training.

The Online Coaching tool is a modular part of the platform and is set up for coaches to help Users reach their fitness goals.

Part of the platform is software provided by FunXtion, to be used on Apple iOS and Android OS devices, which is designed to help Users reach their fitness goals, such by offering workouts Users can do anywhere and anytime, alone or together with others.

Further, the App enables Users to track and trace their progress and share this with other Users.

FunXtion: FunXtion International B.V., a limited liability company incorporated under the laws of the Netherlands. The company is registered with the Dutch Chamber of Commerce under registration number 57141762. The company’s registered office is at Sloterweg 796, 1066 CN Amsterdam, The Netherlands. GDPR: the regulation of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation).

User: a private person making use of the Interactive Platform.

Which personal data do we collect?

When you use the services of FunXtion, visit our website or fill out the contact form on our website, we can process the following personal data from you:

  • your email address
  • your username (which may also be a pseudonym/nickname)
  • your date of birth
  • your gender
  • information about your length, weight, target weight
  • your workout intensity (low/medium/high)
  • your fitness goal (e.g. weight loss, muscle strength)
  • your progress in reaching your fitness goals
  • electronic identification data (log-in data, functional cookies)

For which purposes and on what basis do we collect your personal data?

We need to have your personal data if you want to become a User, or if you want to contact us. Basically, we process your data to enter into a business relationship and agreement with you. In this way, we can manage your personal account and help you to reach your fitness goals. We may also use your contact details to communicate with you. If you opt-in for this, we will send newsletters to the email address you provided us with.

Another purpose of processing your data is to help develop and improve our products and services in order that we can be of service to you and can innovate.

In both cases, we have a legitimate interest in processing your personal data for these purposes.

Do we use automated individual decision-making, including profiling?

By profiling, we mean any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a User, in particular to analyses or predict aspects concerning that User’s performance at health, personal preferences, interests, behaviour, location or movements. We use general profiling and decision-making based on profiling after you have given us your consent. You have the right to obtain human intervention. Also you have the right to express your point of view and contest the decision.

Will your personal data be shared with third parties?

FunXtion will not sell your information to third parties and will only provide this information if this is necessary in order to perform our agreements with you or if we are required to do this by law. With third parties that process your data in our order, we conclude a processor agreement to ensure the same level of security and confidentiality of your data. FunXtion remains responsible for these processing operations.

If we transfer your data to third parties outside the European Union, we take additional measures to protect your data. In some countries outside the European Union, the rules for protecting your data are different from those that apply within Europe. If we make use of a third party located outside the European Union, and if the European Commission believes that the country in which this third party is located does not offer adequate protection in the area of personal data processing, we will only transfer your data if their level of protection matches the GDPR.

Regarding the App, other Users can only see your progress in reaching your fitness goals if you have given explicit permission for this via your personal account.

How do we protect your personal data?

We work hard to protect your personal data against loss or any form of unlawful processing. We have taken appropriate technical and organizational measures to protect your personal data, which are stored encrypted and only accessible through a secret password.

How do we use cookies?

Our website uses cookies for functional purposes. Functional cookies are essential and help you navigate the website. They enhance the user-friendliness of the website for you. These cookies help to support our website security and basic functionality. If you wish to withdraw your cookie consent at any time, you can delete our cookies using your internet browser settings.

What are my rights?

You can view, edit or delete your personal data by logging in to your personal account. If you have problems with viewing, editing or deleting your personal data, please send us an e-mail via info@funxtion.com.

If you make a request as described above, we will respond no later than one month after we receive your request.

Storage periods

We do not store your data longer than necessary for the purpose of the processing, according to article 5 of the GDPR.

Minors

We do not consciously process personal data of minors without the permission of a parent or guardian. If personal data of a minor is processed without permission, we will erase the data after taking knowledge of the fact.

Modifications to this privacy statement

We may update our Privacy Statement from time to time. In that case, the revision date is updated. The most recent version of our Privacy Statement is always made available online at www.funxtion.com.
